These Terms of Service ("Terms") govern your use of the website penthouse4x4.com.au (the "Site") and any purchase you make from Penthouse 4x4 ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Penthouse 4x4 sells rooftop tents, awnings, and 4x4 outdoor accessories to customers in Australia.

Nothing in these Terms limits any rights you have under the Australian Consumer Law (ACL), which cannot be excluded.

2. Eligibility

You must be at least 18 years old, or purchasing with the consent and supervision of a parent or guardian, to place an order on the Site. By using the Site you confirm the information you provide (name, delivery address, contact details, payment details) is accurate and current.

3. Products, Descriptions & Availability

3.1 We make reasonable efforts to accurately describe our products, including images, dimensions, weights, and specifications. Minor variations between product images and the item received (e.g. due to manufacturing batches, screen display, or packaging updates) may occur and do not constitute a breach of these Terms.

3.2 Penthouse 4x4 is currently operating a pre-sell / pre-order model for some or all products. Where a product is listed as a pre-order, estimated dispatch timeframes will be shown on the product page or communicated by email. Placing a pre-order reserves your unit; it does not guarantee a fixed delivery date, and timeframes may shift due to production or shipping factors outside our control.

3.3 We reserve the right to limit quantities, refuse orders, or discontinue any product at our discretion, including where a product is listed in error (e.g. incorrect pricing due to a technical fault).

4. Pricing & Payment

4.1 All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise stated.

4.2 Prices, promotions, and product availability may change at any time without notice, but changes will not affect an order you have already placed and had confirmed.

4.3 Payment is processed securely through our Shopify checkout. By submitting payment details, you warrant that you are authorised to use the chosen payment method.

4.4 In the event of a pricing error that is obvious and unmistakable, we reserve the right to cancel the order and issue a full refund, even after order confirmation.

5. Launch Promotion Terms

From time to time we may run a launch or promotional offer (currently: 50% off the first 20 combined units of eligible tents and awnings).

5.1 The promotion applies to a limited, capped number of combined units across eligible product lines and ends automatically once the cap is reached, regardless of the advertised end date.

5.2 Limit of one discounted unit per order/customer, enforced at checkout. Multiple accounts, orders, or attempts to circumvent this limit may result in order cancellation.

5.3 The promotional discount cannot be combined with any other offer, discount code, or promotion unless explicitly stated.

5.4 We reserve the right to amend, suspend, or end the promotion at any time, including due to fraud, technical error, or stock/unit-count issues, without liability beyond refunding any amount already paid for a cancelled order.

5.5 Additional promotion-specific terms (if any) will be displayed on the relevant promotional page and form part of these Terms.

6. Shipping & Delivery

Shipping timeframes, costs, and methods are set out in our Shipping Policy. Delivery estimates are not guaranteed and may be affected by carrier delays, remote delivery locations, or circumstances beyond our control. Risk in the goods passes to you on delivery.

7. Returns, Refunds & Warranty

Our Refund & Returns Policy sets out how to return a product, request a refund, or make a warranty claim, and forms part of these Terms.

Under the Australian Consumer Law, our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

8. Your Account & Conduct

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. You agree not to:

use the Site for any unlawful purpose;
attempt to circumvent purchase limits (including on promotional stock);
interfere with the security or proper functioning of the Site;
submit false, misleading, or fraudulent information when placing an order.

We may suspend or cancel accounts or orders reasonably suspected of breaching these Terms.

9. Intellectual Property

All content on the Site — including the Penthouse 4x4 name, logo, product photography, 3D configurator, and written copy — is owned by or licensed to us and protected by Australian intellectual property law. You may not reproduce, distribute, or use this content commercially without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law:

10.1 We are not liable for indirect, incidental, or consequential loss arising from your use of the Site or our products, including loss of use, loss of enjoyment of camping/travel plans, or incidental costs.

10.2 Our total liability for any claim relating to a product is limited, at our option, to replacement of the goods, resupply of equivalent goods, or repair/refund of the amount paid.

10.3 Products such as rooftop tents and awnings are intended to be installed and used in accordance with the instructions provided. We are not liable for damage, injury, or loss arising from incorrect installation, misuse, exceeding rated load/weight limits, or failure to follow supplied fitting instructions.

11. Third-Party Links & Services

The Site may link to third-party services (e.g. social media, shipping carriers, payment providers). We are not responsible for the content, policies, or practices of third-party sites.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, promotions, or legal obligations. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms.
